Welcome to LuxeTravel Asia.
These Terms & Conditions explain the basis on which LuxeTravel Asia provides travel planning, tour arrangements and related travel services. They are intended to make the booking process clear and to set out the rights and responsibilities of both LuxeTravel Asia and our travelers.
Please read these Terms carefully before confirming a booking or making any payment.
1. About LuxeTravel Asia
LuxeTravel Asia is the trading name of:

LuxeTravel Asia designs and operates private journeys, tailor made holidays, selected joining group tours and other travel services in Vietnam and across destinations in Asia.
2. Scope of These Terms
These Terms apply to travel services booked directly with LuxeTravel Asia through our website, by email, telephone, messaging platforms or through one of our travel consultants.
Simply browsing our website does not create a travel contract with LuxeTravel Asia.
A booking contract is formed when:
- you accept the relevant Tour Proposal or booking arrangements;
- the required deposit or other agreed payment has been received; and
- LuxeTravel Asia issues written confirmation of your booking.
Your booking may also be subject to specific conditions stated in your Tour Proposal, quotation, invoice or Booking Confirmation. These documents form part of your agreement with us.
Where a booking specific condition differs from these general Terms, the booking specific condition will apply to that booking, provided that it has been clearly disclosed and is permitted by applicable law.
3. Lead Traveler and Booking Authority
The person making the booking is considered the Lead Traveler unless otherwise agreed.
The Lead Traveler is responsible for:
- providing accurate information for all travelers included in the booking;
- ensuring that all travelers are aware of the itinerary, price and relevant booking conditions;
- communicating important information from LuxeTravel Asia to the other travelers;
- informing us promptly of any changes affecting the booking; and
- ensuring that payments are made according to the agreed schedule.
Where personal information is provided on behalf of another traveler, the Lead Traveler should have the appropriate authority to provide that information for the purposes of arranging the journey.
Travelers under the age of 18 must travel under the responsibility of a parent, legal guardian or another responsible adult as required by applicable law and the relevant service providers.
4. Tour Proposals, Availability and Pricing
Our journeys are often individually designed and may include accommodation, transport, flights, cruises, guides, activities, meals and other services supplied by different providers.
Unless specifically stated otherwise, a Tour Proposal is a quotation and does not itself guarantee availability.
Hotels, flights, cruises, guides and other services remain subject to availability until your booking has been confirmed.
Pricing
Tour prices will normally be quoted in United States Dollars (USD) unless another currency is expressly stated.
The Tour Proposal will specify whether the price is:
- per person;
- per room;
- per family or group; or
- a total package price.
Only the services specifically listed as included in your Tour Proposal are included in the quoted price.
Any service not listed as included should be considered excluded unless confirmed otherwise in writing.
Quotation Validity
Prices are based on supplier rates, exchange conditions and availability at the time the proposal is prepared.
A quotation may therefore have a stated validity period. If the booking is not confirmed within that period, LuxeTravel Asia may need to review availability and reprice the arrangements.
Pricing Errors
We take reasonable care to ensure that prices and information are accurate. However, genuine administrative, typographical or system errors may occasionally occur.
An obvious pricing error does not create an obligation to provide a service at the incorrect price before the booking has been confirmed.
If we identify an error before confirmation, we will inform you and provide the correct price before asking you to proceed.
Once a booking has been confirmed, we will not unilaterally increase the confirmed price except where a change is requested or accepted by you, or where otherwise permitted by applicable law and clearly provided for in your booking conditions.
5. Deposits and Payment
A deposit is normally required to confirm your journey.
Unless your Tour Proposal states otherwise, our standard deposit is generally 30% of the tour price where immediate airline ticketing or other substantial non-refundable services are not required.
A different deposit may apply when the journey includes:
- airline tickets requiring immediate issue;
- cruises;
- peak season accommodation;
- special events;
- villas or exclusive properties;
- permits;
- train tickets;
- limited availability services; or
- other arrangements requiring advance or non-refundable payment.
Any different deposit requirement will be clearly stated in your Tour Proposal.
Final Balance
Unless otherwise agreed in writing, the final balance must be paid no later than one day before the scheduled start of your journey.
For certain bookings, LuxeTravel Asia may agree in advance for the remaining balance to be collected by our representative on the first day of the journey in Vietnam. This arrangement must be confirmed with your travel consultant.
Payment Methods
Available payment methods will be stated on your invoice or payment instructions.
Where payment is made by credit or debit card, a 3.5% card processing fee may apply and will be disclosed before payment.
Bank transfer charges, intermediary bank fees and any charges imposed by the traveler’s bank are the responsibility of the payer unless otherwise agreed.
Where your bank or payment provider converts another currency into USD, the exchange rate and conversion charges are determined by that institution. LuxeTravel Asia is not responsible for differences resulting from third party currency conversion.
Late Payment
If an agreed payment is not received by the due date, we will make reasonable efforts to contact you.
Where payment remains outstanding, LuxeTravel Asia may be unable to maintain reservations held with suppliers. After appropriate notice, the booking may be treated as cancelled in accordance with the applicable cancellation conditions.
6. Changes Requested by the Traveler
We understand that travel plans sometimes change.
If you wish to change your:
- travel dates;
- itinerary;
- accommodation;
- flights;
- room arrangements;
- traveler names;
- activities; or
- other confirmed services,
please contact your LuxeTravel Asia travel consultant as soon as possible.
We will make reasonable efforts to accommodate your request.
Changes remain subject to availability and may result in additional costs or supplier amendment fees. We will advise you of any material additional cost before confirming the change.
Certain services, particularly issued airline tickets, cruises, promotional hotel rates and special event bookings, may not permit changes or may treat a change as a cancellation and new booking.
7. Cancellation by the Traveler
Cancellation requests should be made in writing by the Lead Traveler or the person who made the booking.
The effective cancellation date will normally be the date on which LuxeTravel Asia receives the written cancellation request.
Because each journey involves different suppliers and booking conditions, cancellation charges vary by itinerary.
The applicable cancellation schedule and any non-refundable services will be stated in your Tour Proposal, Booking Confirmation or other booking documentation before payment is made.
Cancellation charges may reflect amounts already committed or paid to suppliers such as:
- airlines;
- hotels and resorts;
- cruise companies;
- transport providers;
- rail operators;
- event organizers;
- permit authorities; and
- other travel service providers.
Where a refund is due, LuxeTravel Asia will process the refundable amount as soon as reasonably practicable after the relevant cancellation calculations and, where necessary, supplier refunds have been confirmed.
Bank charges, card processing fees, currency conversion losses and other third party transaction charges may not be recoverable unless required by applicable law.
We strongly recommend travel insurance that includes appropriate trip cancellation and interruption coverage.
8. Unused Services and No Shows
No refund is normally available for services voluntarily missed or unused after a journey has commenced, including accommodation, meals, sightseeing, transportation or activities that a traveler chooses not to use.
This does not affect any rights you may have where a service was not provided because of a failure by LuxeTravel Asia or where a refund is required by applicable law.
A traveler who does not arrive for a confirmed service without notifying LuxeTravel Asia may be treated as a no show and may lose the amount paid for that service according to the relevant supplier conditions.
If you expect to arrive late or miss a service, please contact us as quickly as possible so that we can assist.
9. Changes to the Journey by LuxeTravel Asia
Travel sometimes requires flexibility.
Weather, local conditions, transportation schedules, road access, supplier availability, safety considerations and other circumstances may require adjustments to a confirmed itinerary.
LuxeTravel Asia may make reasonable minor changes where necessary, provided the overall nature and standard of the journey are maintained as closely as reasonably possible.
Examples may include:
- changing the order of sightseeing;
- adjusting departure times;
- using an alternative route;
- replacing a hotel or cruise with a reasonably comparable alternative; or
- modifying an activity because of weather, safety or local operating conditions.
Where we become aware of a material change before departure, we will inform you as soon as reasonably possible and explain the available alternatives.
Depending on the circumstances, these may include accepting the revised arrangements, selecting a suitable alternative where available, or cancelling the materially affected arrangements in accordance with applicable law and the relevant booking conditions.
We will not make material changes solely for our convenience without considering their effect on the traveler.
10. Cancellation by LuxeTravel Asia
LuxeTravel Asia may occasionally need to cancel a journey or an individual service.
Where we cancel confirmed arrangements for reasons within our reasonable control, we will normally offer you one of the following:
- suitable alternative arrangements of comparable value, where available; or
- a refund of the amounts paid to LuxeTravel Asia for the services we have cancelled.
Where cancellation results from circumstances beyond our reasonable control, the provisions under Force Majeure below will apply.
For joining group tours that require a minimum number of participants, any minimum requirement and related cancellation conditions will be disclosed before booking.
11. Force Majeure
A Force Majeure event means an exceptional event or circumstance beyond the reasonable control of LuxeTravel Asia, the traveler or the relevant supplier, which could not reasonably have been prevented or avoided.
Such events may include, without limitation:
- severe weather or natural disasters;
- typhoons, floods, earthquakes or landslides;
- fire;
- epidemics, pandemics or significant public health emergencies;
- quarantine or border restrictions;
- acts or orders of government or public authorities;
- war or threat of war;
- terrorism;
- civil unrest, riots or political instability;
- strikes or significant labor disruption;
- airport, port or border closures;
- major transportation disruption;
- unexpected closure of tourist attractions;
- interruption of essential infrastructure; or
- other comparable events beyond reasonable control.
If Force Majeure affects your journey, LuxeTravel Asia will make reasonable efforts to:
- keep you informed;
- protect your safety and wellbeing;
- provide practical assistance;
- rearrange services where reasonably possible; and
- seek refunds or credits from affected suppliers where appropriate.
Depending on the circumstances, additional accommodation, transportation, meals, flights or other arrangements required because of a Force Majeure event may involve additional cost.
Where services cannot be provided because of Force Majeure, any refund, credit or rebooking will take account of amounts that can reasonably be recovered from suppliers and any unavoidable costs already incurred, subject always to rights available under applicable law.
LuxeTravel Asia will not be responsible for indirect or consequential losses resulting solely from a Force Majeure event where such liability may lawfully be limited or excluded.
12. Private Journeys and Joining Group Tours
LuxeTravel Asia offers both private and joining group travel arrangements.
Private Journeys
A private journey generally means that the guide and/or vehicle arrangements specified as private in your itinerary are reserved for your traveling party.
It does not necessarily mean exclusive access to hotels, attractions, restaurants, cruises, public areas or other facilities unless expressly stated.
Joining Group Tours
On a joining group tour, you may travel with other guests.
Departure times, sightseeing arrangements and the overall pace may therefore need to follow the agreed group program.
Where a group tour requires a minimum number of participants, this will be stated before booking whenever applicable.
13. Accommodation
We select accommodation based on the agreed journey, destination, availability, location, service level, character and budget.
Hotel classifications and star ratings vary between countries and may be based on local standards. A hotel described as four or five star in one destination may not be directly equivalent to a similarly rated hotel elsewhere.
Specific room types, bedding configurations, connecting rooms, adjoining rooms, views and hotel facilities are subject to availability and supplier confirmation.
We will make reasonable efforts to secure confirmed special room requests but cannot guarantee requests that are controlled solely by the accommodation provider unless specifically confirmed.
Check In and Check Out
Standard hotel check in is generally in the afternoon and check out is generally in the morning or around midday, depending on the property.
Early check in and late check out are not included unless expressly stated.
They may be requested in advance and may involve an additional charge.
14. Flights, Cruises, Trains and Transportation
Airlines, cruise companies, railway operators and other transport providers operate under their own schedules, conditions of carriage and safety requirements.
Flight times and other transportation schedules may change after booking.
Where LuxeTravel Asia is informed of a significant schedule change affecting your itinerary, we will make reasonable efforts to adjust the surrounding arrangements.
Issued airline tickets may be:
- non-refundable;
- non-changeable; or
- subject to airline amendment and cancellation fees.
The applicable conditions will depend on the fare and carrier.
Travelers are responsible for ensuring that the names supplied for airline and transport reservations match their travel documents exactly.
Baggage
Baggage allowances vary by airline, aircraft, fare type, cruise and transportation provider.
Your LuxeTravel Asia consultant may provide baggage information as part of your travel arrangements, but travelers should check the final allowance shown on their ticket or carrier documentation.
Excess baggage charges are the responsibility of the traveler unless expressly included.
15. Passports, Visas and Entry Requirements
Each traveler is responsible for holding the documents required for the journey, including as applicable:
- a valid passport;
- visas;
- entry permits;
- vaccination or health documentation;
- onward or return travel documentation; and
- any documents required for minors.
Passport validity and entry requirements vary by nationality and destination and may change without notice.
LuxeTravel Asia may provide general information or visa assistance where requested, but such assistance does not constitute a guarantee that a visa or entry permission will be granted.
Final decisions concerning visas, immigration and admission into a country are made by the relevant government authorities.
LuxeTravel Asia is not responsible for a traveler being refused boarding or entry because the traveler does not hold the required documents, except to the extent that such loss results directly from incorrect information supplied by LuxeTravel Asia and liability cannot lawfully be excluded.
16. Health, Fitness and Special Requirements
Some journeys include physical activities such as:
- trekking;
- cycling;
- kayaking;
- boating;
- swimming;
- climbing steps;
- walking on uneven surfaces; or
- visiting remote locations.
Travelers should consider whether an itinerary is suitable for their individual level of fitness and mobility.
Please tell your LuxeTravel Asia consultant before booking about any mobility requirement, dietary requirement or other circumstance that may materially affect participation in the journey.
We will make reasonable efforts to accommodate special requests, but availability may depend on local suppliers and facilities.
Travelers should obtain appropriate professional medical advice regarding health, medication, vaccinations and fitness for travel where necessary.
17. Children and Family Travel
Child pricing varies according to:
- the child’s age;
- accommodation arrangements;
- bed requirements;
- airline rules;
- cruise policies;
- activity providers; and
- other supplier conditions.
For this reason, LuxeTravel Asia does not apply one universal child discount across all journeys.
Any applicable child price will be stated in your Tour Proposal.
Parents, guardians or responsible accompanying adults remain responsible for supervising minors throughout the journey.
Some activities may have minimum age, height, health or safety requirements.
18. Travel Insurance
LuxeTravel Asia requires travelers to have appropriate travel insurance for their journey.
We strongly recommend comprehensive coverage including, where appropriate:
- overseas medical expenses;
- emergency evacuation and repatriation;
- trip cancellation;
- trip interruption;
- travel delays;
- personal belongings;
- accidents; and
- participation in planned activities.
Travelers are responsible for reviewing their policy carefully and ensuring that the level and type of coverage are suitable for their itinerary.
Where Vietnamese tourism regulations require LuxeTravel Asia to arrange insurance for travelers during a tour, LuxeTravel Asia will comply with the applicable requirements unless the traveler already holds insurance covering the entire program as permitted by law.
The insurance arranged as part of a tour, where applicable, should not be assumed to replace comprehensive personal travel insurance.
We may request evidence of appropriate insurance for certain journeys or activities.
19. Traveler Conduct and Responsibilities
Travelers are expected to:
- comply with the laws and regulations of the destinations visited;
- follow reasonable safety instructions from guides, drivers, authorities and service providers;
- respect local culture, customs, communities and the environment;
- behave respectfully toward fellow travelers, employees and suppliers; and
- avoid conduct that creates a serious risk to themselves or others.
Where a traveler’s behavior seriously threatens safety, disrupts a journey, violates local law or makes continued participation unreasonable, LuxeTravel Asia may take appropriate steps to protect the traveler, other guests, staff and suppliers.
In serious circumstances, this may include ending the traveler’s participation in an activity or journey.
Any decision of this kind will be made reasonably and according to the circumstances.
Costs arising directly from a traveler’s unlawful or seriously disruptive conduct may be the responsibility of that traveler, subject to applicable law.
20. Third Party Suppliers
LuxeTravel Asia works with hotels, airlines, cruise operators, transport companies, restaurants, guides, activity providers and other independent suppliers in delivering travel arrangements.
These suppliers may have their own terms, safety rules, operating procedures and cancellation policies.
The use of independent suppliers does not exclude any responsibility that LuxeTravel Asia is required to accept under applicable law.
Where a supplier directly provides a service, its own terms may also apply to the operation of that particular service.
LuxeTravel Asia will exercise reasonable care in selecting and coordinating suppliers appropriate to the agreed journey.
21. Liability
LuxeTravel Asia accepts responsibility for the travel services we have agreed to provide to the extent required by applicable law.
Nothing in these Terms is intended to:
- exclude liability that cannot lawfully be excluded;
- remove a consumer right provided by applicable law; or
- prevent a traveler from making a lawful complaint or claim.
LuxeTravel Asia will not be responsible for loss arising solely from:
- the traveler’s own act or omission;
- the independent act of an unrelated third party that could not reasonably have been anticipated or prevented;
- inaccurate information supplied by the traveler;
- a traveler’s failure to comply with entry, legal or safety requirements; or
- a Force Majeure event,
except where liability is imposed on LuxeTravel Asia by applicable law.
Travel inherently involves some risks. Participation in activities such as trekking, cycling, kayaking and other active experiences may involve risks that cannot be completely eliminated even where reasonable safety precautions are taken.
Travelers are expected to follow safety instructions and exercise reasonable care.
Nothing in this section limits liability for death, personal injury, fraud, willful misconduct or other liability to the extent such liability cannot lawfully be limited or excluded.
22. Personal Belongings
Travelers remain responsible for their passports, money, electronic devices, luggage and other personal possessions.
We recommend using hotel safes or other secure facilities where available and taking reasonable precautions against loss or theft.
If property is lost or stolen during the journey, our local team will provide reasonable assistance where possible, including helping the traveler contact the relevant hotel, transport company or local authority.
23. Complaints and Assistance During Travel
We want any problem to be addressed as quickly as possible while you are traveling.
If you are dissatisfied with any part of your journey, please notify your local guide, LuxeTravel Asia travel consultant or our support team as soon as reasonably possible.
This gives us an opportunity to investigate and, where possible, resolve the issue during your trip.
If the matter is not resolved locally, we encourage you to submit a written complaint within 15 days after completion of your journey, together with relevant details, photographs, receipts or other supporting information where appropriate.
The 15 day period is intended to help us investigate matters promptly. It does not remove or limit any complaint or consumer right available to you under applicable law.
We will review complaints fairly and respond within a reasonable period according to the nature and complexity of the matter.
24. Communications and Travel Documents
Booking confirmations, invoices, travel documents and other communications may be provided electronically.
You are responsible for providing accurate contact details and checking communications relating to your booking.
Please review your Booking Confirmation and travel documents when received and notify us promptly if any information appears incorrect.
Travel vouchers and final documents will be issued according to the arrangements stated in your Booking Confirmation and payment schedule.
For urgent changes, cancellations or problems close to departure or during travel, please use the emergency or customer support contact information provided with your travel documents rather than relying solely on email.
25. Photography, Video and Guest Feedback
LuxeTravel Asia may occasionally take photographs or video during journeys.
We do not treat the purchase of a journey as automatic consent to use an identifiable traveler’s image for promotional purposes.
Where we wish to use identifiable photographs, video, testimonials or other personal content for marketing, social media or promotional purposes, we will seek appropriate permission where required.
If you prefer not to appear in photographs or video being taken during a tour, please tell your guide or LuxeTravel Asia representative.
Additional consent requirements may apply where children are involved.
Feedback provided to us may be used internally to improve our services. Identifiable testimonials, names, photographs or other personal information will be handled in accordance with our Privacy Policy and applicable law.
26. Website Information and Intellectual Property
We make reasonable efforts to keep the information on luxetravelasia.com accurate and current.
Travel conditions, visa requirements, opening hours, transportation schedules, weather information, supplier services and destination conditions can change. Website content should therefore be regarded as general travel information unless incorporated into a confirmed booking.
Information on our website does not constitute legal, medical, immigration or other professional advice.
Unless otherwise stated, the website design, written content, graphics, branding, photographs and other original materials owned by LuxeTravel Asia are protected by applicable intellectual property laws.
Content may be viewed, saved or printed for personal and non-commercial use.
It may not be copied, republished, commercially distributed, modified or used to create derivative commercial content without prior written permission from LuxeTravel Asia, except where permitted by law.
27. External Websites
Our website may contain links to websites operated by third parties.
These links are provided for convenience or additional information.
LuxeTravel Asia does not control third party websites and is not responsible for their content, privacy practices, availability or security.
Access to a third party website is subject to that website’s own terms and policies.
28. Privacy and Personal Data
LuxeTravel Asia processes personal information in order to prepare journeys, make reservations, provide travel services, communicate with travelers and meet legal or operational requirements.
Our handling of personal information is explained separately in our Privacy Policy, which should be read together with these Terms.
Where consent is required for a particular use of personal data, such consent will be requested in accordance with applicable law.
29. Governing Law and Dispute Resolution
These Terms and bookings made directly with LuxeTravel Asia are governed by the laws of the Socialist Republic of Vietnam, subject to any mandatory consumer protections that may apply.
If a disagreement arises, both you and LuxeTravel Asia are encouraged to first attempt to resolve the matter through direct discussion and good faith negotiation.
Please contact us with details of the issue so that we have a reasonable opportunity to investigate and respond.
If a dispute cannot be resolved amicably, it may be submitted to the competent courts or other dispute resolution bodies in accordance with applicable law.
Nothing in this section removes any mandatory right or remedy available to a consumer under applicable law.
30. Language
These Terms may be made available in Vietnamese and English.
Where applicable law requires a Vietnamese version, LuxeTravel Asia will maintain the relevant Vietnamese documentation.
If there is any inconsistency between language versions, the interpretation and version applicable to the consumer will be determined in accordance with Vietnamese law and any other mandatory consumer protection rules that apply.
31. Changes to These Terms
LuxeTravel Asia may update these Terms from time to time to reflect changes in our services, operations or applicable law.
The current version and its effective date will be published on our website.
Changes will normally apply to bookings made after the revised Terms become effective.
A confirmed booking will remain subject to the Terms accepted at the time of confirmation unless:
- a change is required by law;
- the change does not materially reduce the traveler’s rights; or
- the traveler and LuxeTravel Asia expressly agree otherwise.
32. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary under applicable law.
The remaining provisions will continue to apply.
